George Tarabishi's Interpretation of the Origins of Jurisprudence and Sunnah: A Critical Review through an Analysis of Some Early Jurisprudential Discussions

Abstract
George Tarabishi's works are key contributions to modern Arab thought, particularly in the realm of jurisprudence. His analysis, grounded in Marxist principles, connects the development of the Sunnah to the intersection of interests between the ruling elite, driven by the conquests and their governance needs, and the educated Mawali, who came from the ranks of the conquered peoples. These Mawali were tasked with creating the Sunnah to address the limited scope of Qur'anic texts dealing with legal provisions and governance. This research aims to offer a critique of this conception in light of some principles of interpretive sociology, and to highlight the weakness of Tarabishi's approach, which neglects the roles of social actors and focuses on political, ideological, and class factors in analyzing and interpreting social phenomena. The research was divided into two axes: The first explores Tarabishi's perspective on the development of the Sunnah and the establishment of jurisprudence in regions like the Hijaz and Iraq. It delves into his interpretation of this evolution, emphasizing the pivotal role played by the Mawali and how their interests aligned with those of the Umayyad aristocracy. The second was devoted to evaluating this concept in light of some principles of interpretive sociology, and revealing the impact of neglecting these principles on the weakness of the results reached by Tarabishi. The study found that Tarabishi's analysis of the development of Islamic jurisprudence neglected the contributions of the Companions and did not adequately address the work of contemporary scholars in organizing and evaluating the Sunnah. Additionally, his perspective fell short in clarifying why jurists, including the People of Opinion, consistently adhered to the Sunnah, despite the Quran not mandating such adherence—a commitment that represented an unnecessary burden rather than an invented necessity.
