The Nature of Jurisprudential Knowledge and its Balance between Theory and Application: An Introduction to the Epistemology of Islamic Jurisprudence
Abstract
This research explores the epistemological foundations of Islamic jurisprudence by addressing three central issues: the role of reason in legal theory, the tension between absoluteness and relativity in jurisprudential knowledge, and the balance between certainty and conjecture. Beginning with the rationalist orientation of Islamic epistemology as articulated in the Qur’an and elaborated through Kalam, the study traces the roots of these problems both in philosophical theorization and in their practical manifestations within detailed jurisprudential rulings. It ultimately shows that jurisprudential knowledge rests on distinctive equilibria in each domain, making jurisprudence a dynamic model of intellectual flexibility and creativity—one that integrates the strengths of epistemological and ethical theories while avoiding many of their classical and modern pitfalls.
