Establishing the Objectives of the Human Common
Abstract
This research attempts to contribute to the rooting of the concept of (the human common), which is a global concept that intersects with some of the original Islamic concepts, which are included in the science of the purposes of Sharia. The research has shown the most important concepts, sources and legal principles that establish this concept in the Islamic vision. The research also attempted to present a thesis to integrate the concept of (the human common) within the system of purposes of Sharia, by revealing the intentional entrances to the legitimacy of the origin of the human common, and how it might affect the theory of intentional jurisprudence. And he concluded that the container of the purposes of the Sharia is the most appropriate framework to accommodate the concepts, perceptions, ideas and behaviors that can bring benefits and ward off harm for all people. And that the concept of (the human common) is an inclusive concept of a group of innate principles, sound ethics and beneficial behaviors that the general public shares an interest in and care for. And that the common reference that constitutes the state of participation in the concept of (the human common) is due to several sources, including instinct, the right mind, and the social interest that people meet to manage their affairs and their differences. And that the basis / the founding link for the idea of the purposive necessities is a purely human basis that minds, laws and religions do not differ on, and it is one of the most important contents of (the human common).
