A Reading of the Book: The Controller of Certainty and Suspicion in the Discussions of the Fundamentals of Jurisprudence and Its Normative Function: A Descriptive Study

Abstract

This research aims to shed light on a book by Abdul Hamid Al-Raqi entitled: “The Controller of Determination and Suspicion in Discussions on the Fundamentals of Jurisprudence and Its Normative Function,” in which he addresses the problem of certainty and suspicion in the fundamentals of jurisprudence. In dealing with this issue, the author approached the inductive approach to the investigations of the fundamentals of jurisprudence. We monitored its contents in a focused manner, and came up with what the author concluded in each section, before arriving at the conclusions of the research as a whole, in the end, we deconstruct the symbols of the term ‘usul’ that is ruled by certainty or suspicion, and clarify the role of this criterion (certainty and suspicion) and its normative function in the investigations of the science of jurisprudence. It is also concluded that the necessity of defining the term ‘usul’ ruled by certainty or suspicion by scholars, in its types, and the time of judging.
