Right and Democracy: Returning to Habermas’ Procedural Approcah
Abstract
This study sheds light on a very crucial intellectual subject related to contemporary political and legal philosophy; right and democracy, applying the procedural approach of the German philosopher, Jurgen Habermas, who passionately defended the harmony between right and democracy and the mutual relationship between them within a framework of understanding, being the best approach for setting the differences within ethically, linguistically, culturally, and doctrinally diverse space. Hence, public space is the only guarantee emphasizing the legitimacy of right and democracy being keen to make the process of opinion formation and will through ensuring a communicative and argumentative subjectivity based on dialogue, consultation and the strongest argument instead of conflict, force and authority. This process ensures everybody’s contribution in establishing the project of right and democracy, irrespective of their diverse cultural backgrounds, being an educational project and everyday style.
